North Peak retains ownership of its internal processes, templates, source files, and intellectual property until full payment has been received, unless otherwise agreed in writing.

You are responsible for providing accurate information when contacting us or engaging our services, and for maintaining the confidentiality of any account credentials we issue to you.

All project pricing is provided through custom quotes based on your scope, goals, and requirements. Quotes are valid for a limited time as stated on each proposal, after which pricing may be reviewed.

Payment terms are outlined in each project agreement. Invoices are due by the date specified. Late payments may incur additional fees and may pause project work until the balance is settled.

Project timelines are estimates based on the agreed scope. Actual delivery depends heavily on client responsiveness — including timely feedback, content delivery, and approvals.

Clients are responsible for providing logos, text, images, and other requested content unless content creation is included in the agreed scope. Delays in providing these materials may impact the project timeline.

The number of revision rounds is outlined in your project agreement. Additional revisions beyond that may be billed separately. Projects delayed by client inactivity for extended periods may be paused or rescheduled.

Either party may terminate a project according to the terms of the signed project agreement. Work completed up to the cancellation date remains billable.

Because our services involve custom work, deposits and payments for completed work are generally non-refundable. Any refund considerations are handled on a case-by-case basis according to the terms of your project agreement.

North Peak is not responsible for downtime or issues caused by third-party hosting providers, domain registrars, payment processors, internet service providers, or software vendors. We'll help troubleshoot, but resolution ultimately depends on the provider.

When hosting is included in your plan, we provide managed hosting through trusted providers. Uptime and performance are governed by the underlying provider's terms.

Ongoing maintenance covers the tasks defined in your plan (updates, backups, minor content changes, monitoring). Larger changes outside the plan's scope are quoted separately.

Google Ads performance depends on many external factors including competition, budget, market conditions, and seasonality. While we apply proven strategies and continuous optimization, we cannot guarantee specific results.

North Peak strives to build high-quality websites and campaigns, but we cannot guarantee search engine rankings, specific business outcomes, sales increases, advertising performance, or future revenue.

To the fullest extent permitted by law, North Peak's total liability for any claim related to our services is limited to the amount paid by the client for the applicable services. We are not liable for indirect, incidental, or consequential damages.

You agree to indemnify and hold harmless North Peak from any claims, damages, or expenses arising from your use of our services, your content, or your violation of these Terms or applicable law.

Our Privacy Policy explains how we handle personal information. By using our services, you also agree to that policy.

We may suspend or terminate access to our website or services if these Terms are violated. Either party may end a client engagement in accordance with the signed project agreement.

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of the site or services after changes means you accept the updated Terms.

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Texas.
